NACS Letter: Don't Allow EPA to Regulate Greenhouse Gas Emissions

NACS letter to the chair of the House Committee on Energy and Commerce expresses support of the Energy Tax Prevention Act.

WASHINGTON - NACS sent a letter yesterday to Representative Fred Upton (R-MI), chair of the House Committee on Energy and Commerce, expressing the association??s support of H.R. 910, the Energy Tax Prevention Act, which would prohibit the United States Environmental Protection Agency (EPA) from regulating greenhouse gas (GHG) emissions under the Clean Air Act.

The letter relayed concerns that NACS members have relating to how the EPA regulation of GHGs "could now or in the future impose an unsustainable burden on their companies and their employees."

"Regulating every one of the more than 165,000 retail outlets across America that sells motor fuels is a daunting task that will overwhelm state and local permitting offices, halt business growth and expansion, and could force many retailers to close," NACS wrote.

NACS acknowledged that developed a GHG reduction program is the responsibility of Congress, but that the responsibility should not be ceded to the EPA.

"We therefore applaud your effort to preserve Congressional authority over federal policy, to protect American businesses and State governments from overly-burdensome regulations, and to provide adequate opportunity for lawmakers to craft balanced legislation that will enhance environmental protection while promoting economic development," NACS concluded in its appeal.
